Alberta RTA s. 14: a landlord may not increase rent more than once in any 12 months and must give the tenant at least three months' written notice (periodic) or three full tenancy months' notice for a fixed-term tenancy. There is no rent-control cap in Alberta.
5. Security Deposit
Alberta RTA s. 44: the security deposit may not exceed one month's rent. The deposit must be held in an interest-bearing trust account and returned within 10 days after the tenant moves out, less any lawful claims, with a written statement of any deductions and supporting receipts.
6. Services and Utilities
Services and utilities are included in the rent only as expressly stated below. All others are the responsibility of the tenant.
7. Statutory Obligations
- The landlord shall maintain the rental unit in a good state of repair and fit for habitation, and shall comply with all health, safety, housing and maintenance standards.
- The tenant shall keep the rental unit reasonably clean and shall repair any damage caused by the tenant or the tenant's guests.
- The landlord shall provide a copy of this signed agreement to the tenant within 21 days of signing.
- The landlord shall not enter the rental unit except on 24 hours' written notice or in an emergency.
- The tenant shall not assign or sublet without the landlord's consent, which shall not be unreasonably withheld.
- Smoking is prohibited inside the unit unless expressly permitted in Additional Terms.
- The tenant shall obtain tenant insurance covering personal property and third-party liability prior to the start date.
- Either party may terminate this tenancy only as provided by the governing residential tenancies legislation.
- This agreement does not waive any right of either party under the governing legislation. Any term that conflicts is unenforceable to the extent of the conflict.
- In a fixed-term tenancy, the tenancy ends automatically on the end date and the tenant must vacate unless a new agreement is signed (RTA s. 9).
- The landlord shall ensure the rental unit meets the minimum housing and health standards under the Public Health Act and Minimum Housing and Health Standards.
