Manitoba RTA s. 117: a landlord may not increase rent more than once in any 12 months and must give the tenant at least three months' written notice before the increase takes effect. Annual rent-increase guidelines are published by the Residential Tenancies Branch.
5. Security Deposit
Manitoba RTA s. 100: the deposit may not exceed half a month's rent. The landlord must hold the deposit in trust and return it within 14 days after the tenant moves out (less any lawful claims). Interest at the prescribed rate is payable to the tenant when the deposit is returned (s. 103).
6. Services and Utilities
Services and utilities are included in the rent only as expressly stated below. All others are the responsibility of the tenant.
Default position: tenant pays electricity, gas, internet, telephone, cable. Landlord pays water, sewer, garbage collection, snow removal of common areas, and maintenance of common areas. Override in Additional Terms below.
7. Statutory Obligations
- The landlord shall maintain the rental unit in a good state of repair and fit for habitation, and comply with all health, safety, housing and maintenance standards (RTA s. 59).
- The tenant shall keep the rental unit reasonably clean, repair damage caused by the tenant or the tenant's guests, and not commit or permit damage or interference (RTA s. 60).
- The landlord shall provide a written receipt on request and a copy of this signed agreement to the tenant within 21 days (RTA s. 13(3)).
- The landlord shall not enter the rental unit except on 24 hours' written notice or in an emergency (RTA s. 79).
- The tenant shall not assign or sublet without the landlord's consent, which shall not be unreasonably withheld (RTA s. 47).
- Smoking is prohibited inside the unit unless expressly permitted in Additional Terms below. Cannabis cultivation is prohibited unless expressly permitted.
- The tenant shall obtain tenant insurance covering personal property and third-party liability prior to the start date.
- Either party may terminate this tenancy only as provided by the Residential Tenancies Act (Parts 8 and 9). Notice must be in writing and meet the statutory minimum periods.
- Rent received late may attract a non-sufficient-funds (NSF) charge of up to the bank's actual cost.
- This agreement does not waive any right of either party under the RTA. Any term that conflicts with the Act is unenforceable to the extent of the conflict (RTA s. 8).
